AdviceMagic Terms of Service (for non-enterprise customers)

Introduction and parties

Welcome to AdviceMagic, a Software as a Service (SaaS) platform operated by Grizzly Ventures Limited ("AdviceMagic," "we," "us," or "our"). 

By accessing and using our platform, you ("you" or "your") agree to be bound by these terms of service ("Terms"). 

These Terms constitute a legal agreement between you and AdviceMagic, so please read them carefully before using our platform.

By signing up and using our platform, you agree to these terms.

AdviceMagic is a trading name of Grizzly Ventures Ltd. A limited liability company registered in England.

Services provided

The Advice Magic platform enables you to contact your clients and prospects via email and social media using the content provided to you by Advice Magic.

You agree to use our platform in accordance with these Terms, as well as any additional guidelines, policies, or instructions we may provide.

Contact permissions

You must have permission to contact all contacts uploaded to AdviceMagic. For example, contacts must have explicitly opted in to receive communications from you. 

It is your responsibility to ensure that you have adequate permissions to contact any contacts you upload to AdviceMagic. 
AdviceMagic is in no way liable for any consequences or damages which may arise   from your failure to obtain adequate permissions to allow you to market to or contact your contacts or prospects.

Your account details

In order to use our platform, you must create an account with AdviceMagic. 

You agree to provide accurate and complete information during the registration process and to keep your account information up-to-date at all times. 

You are solely responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account.

Subscription fees

Advice Magic operates by way of a monthly subscription fee. The monthly fee you pay  will depend upon which plan you opt to subscribe to with AdviceMagic. 

Unless otherwise agreed in writing, this fee must be paid via credit or debit card using our payment processing system. 

You agree to pay all fees and charges associated with your subscription plan, and to provide us with a valid payment method. If your payment method fails or your account is overdue, we reserve the right to suspend or terminate your account. We also reserve the right to collect any unpaid fees.

Cancelling your subscription

Unless otherwise agreed, you can cancel your AdviceMagic subscription at any time. 

To cancel your subscription please email us at support@advicemagic.com. 

Subscriptions are charged on a rolling monthly basis. If you choose to cancel your subscription the cancellation is deemed to be effective at the next renewal date of such subscription. Advice Magic is not liable to provide a refund for any unexpired period. Cancellation of a subscription does not automatically terminate this agreement.

Your license to use our content

As a user of AdviceMagic, you may use our content (articles, email newsletters, social media content) for the specific purpose of communicating with your clients or prospects via the AdviceMagic platform. You may only use this content in the manner facilitated by the AdviceMagic platform. 

You may not use our content for any other purpose without our written consent. 

In allowing you to use our content for this specific purpose AdviceMagic does not lose ownership of this content. 

AdviceMagic remains the sole owner of the content and all copyright is owned by AdviceMagic.

Processing data

You agree to allow AdviceMagic to process your data so that we can deliver the functionality of the AdviceMagic platform to you.

Our right to modify these terms

We may change or modify these terms.

We may change or modify AdviceMagic in order to release additional features or change our product offering at our discretion.

We may suspend or withdraw our site

We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We reserve the right to suspend or withdraw or restrict the availability of all or any part of our site including for business and operational reasons.

Liability arising from incorrect information 

Whilst all reasonable care is taken to ensure that information on the AdviceMagic platform and the content provided on the platform is accurate, we are not liable for any inaccuracies and any consequences or damages resulting from any such inaccuracies.

Limitations of liability

We have no liability to you for any loss of profit, loss of business, business interruption, loss of business opportunity or any other consequences or damages arising out of   your use of AdviceMagic.

Jurisdiction

This Agreement is governed exclusively by the law and jurisdiction of England and Wales.
